Person with speech disability for Graduation in Medical field?
A petitioner recently challenged in the Supreme Court of India against the rule 2019 Amendment of Regulations on Graduate Medical Education, 1997, according to which people with speech or language benchmark disability are not allowed taking admission in MBBS courses and no reservation is given to these candidates.
The petitioner’s advocate Mr. Gaurav Agarwal, mentioned that why are the people with speech or language benchmark disability not given the opportunity to go for medical graduation . He also said that the petitioner had problem of Cleft Lip Palate Repair which is permanent and was quantified with 55% . And he added that 50% of the time people understood what she said and 50% of the time people might not get what is says.
According to the advocate , petitioner had got seat in college of karnal , but later it was taken back after and her admission got cancelled . After that she decided to reach the apex court of India.
Although , the judge reaction over it was, “You should have come here. We would have passed an order under A. 142 and protected her. Poor Girl lost her admission. I was very disturbed when I read the petition.
As per the rules, people with this disability , quantified less than 40 percent , can avail the reservation but , people with 40% or more cannot avail this reservation . The petition is against this and states that what is happening is against the Right of Person with Disabilities Act, 2016
this is pure discrimination and , if one does not face any intellectual disability or any physical disability and only has speech defect of 40% , why that person has to face this huge problem and this is injustice with all those who have this problem.
A Report was formulated by the NMC of India according to which the candidates with verbal disability of more than 40% cannot be admitted into medical college , then in 2019 there was some amendment made to the Regulations on Graduate Medical Education, 1997 taking the suggestion of some experts .
In the 2021, the petitioner got her disability certificate and she appeared in the NEET UG 2021 entrance examination and after exam she was also allotted the seat in college of karnal but in later this seat was taken back as she was declared ineligible as per the regulation of 2019 , even after Re-verification exercise there was such change in her disability status.
After that she filed a case in the high court but got no such yield to the problem she was actually facing and had to apply in the Supreme Court of India.
