High court, suggested the petitioners to look after whether the similar cases like SEBC Reservations for NEET-PG in the state Kerala are pending in Supreme court or not.
A plea was filed against the extended reservations in medical postgraduate courses for SEBC (Socially and Economically Backward Classes). The Kerala High Court while considering this argumentation insisted the applicants to decasualize whether the similar arguments are under consideration in front of supreme court or not.
The case was given prior importance, but if similar argumentations have been already presented in the Supreme court then making a decision on this matter would be unethical, says the HC bench including Justice N.Nagaresh.
According to the medical reports,a team of doctors had lately impeded the High Court regarding their petition against the state government’s judgement of increased reservation policy in post graduation courses for SEBC.
Earlier,for Socially and Economically Backward Classes the reservation criteria was 9%. This SEBC reservation has recently been enhanced to 27%. This decision has made a demure partiality to the merit of the doctors who had appeared for NEET-PG 2021. Thus they have filled petion favouring this argument, as according to them this increment has led to the infringement of the constitutional norms.
The petitioner medicos designated the matter of fact that, according to the consecutive considerations of the Apex Court reservations are always at minimal level in post graduation and super specialisation courses.
They debated whether the supreme court’s judgement had been violated via the State circular. They also referred to the verdict of Apex court in case of Dr. Preethi Shreevasthava against the M.P states this reference, in which the court elucidated that at the level of super specialization reservations slackened the merit.
During the hearing session of Tuesday several other verdicts were referred, the council of applicants and senior Advocate Sukumaran presented that many similar cases are still unresolved before the Apex Court.
The High court’s single bench reconsidered all the facts and advised the applicants that if the similar cases are still unresolved in the Supreme court then it will be unethical for the high court to make any decision.
According to the reports, the petitioner’s counsel elucidated all the drawbacks of horizontal and vertical reservations. The court looked into the matter and gave another hearing for the case.
