Canada Introduces Overhauled Immigration Regulations

Canada’s Minister of Citizenship, Immigration, and Multiculturalism, Jason Kenney, recently announced significant changes to the Federal Skilled Worker Program (FSWP), with the new selection system set to be implemented on May 4, 2013. The program had been temporarily frozen in June 2012 to undergo these modifications.

Kenney highlighted the transformative nature of these changes, emphasizing their positive impact on skilled newcomers, the economy, and all Canadians. The development of the new FSWP took about four years and is designed to address issues faced by highly educated immigrants, including unemployment, lower wages, and barriers such as language skills, foreign credential recognition, and a lack of Canadian work experience.

The main objectives of the revamped FSW program include rebalancing points among existing criteria, introducing mandatory language thresholds, streamlining the arranged employment process, and reducing the potential for fraudulent job offers.

Here’s a summary of the key changes:

Passing Grade:

  • The passing grade for points remains at 67 out of 100.

Language (Maximum 24 Points):

  • Points increased from 16 to 28, making it the largest category in the point roster.
  • Language tests will no longer be self-declared and must go through IELTS or CELPIP external testing bodies.
  • Secondary language points reduced from 8 to 4.

Language Levels and Corresponding Points:

  • Basic: Understands main points and details; can write routine business correspondence.
  • Moderate: Understands technical conversations; asks questions and analyzes information.
  • High: Participates in business meetings and debates; understands a broad range of topics.

Age (Maximum 12 Points):

  • Favors younger immigrants with a maximum of 12 points for applicants aged 18 to 35.
  • Deduction of one point per year starting from age 47.

Education (Maximum 25 Points):

  • Points based on Canadian educational credentials.
  • Applicants need to submit qualifications to a credential evaluation service.
  • Regulated occupation applicants require approval from the Canadian regulatory body.

Work Experience (Maximum 15 Points):

  • Points reduced to 15 from 21.
  • Double points for applicants with at least one year of Canadian work experience.

Arranged Employment (Maximum 10 Points):

  • Elimination of the Arranged Employment Opinion.
  • All applicants must apply to Service Canada for Labour Market Opinions (LMO).

Adaptability (Maximum 10 Points):

  • One-year of skilled work experience grants 10 points.
  • Spouses receive 5 points for the same experience.
  • 5 points for a relative in Canada, with the relative needing to be at least 18 years old.
